- Food laws currently prohibit health claims appearing on food labels
- Health claims are currently limited to specific instances in which there is significant agreement concerning the relationship between a nutrient, food or food constituent, and disease, e.g.
- there is a link between folate deficiency and neural tube defects
- Manufacturers who add folate to their foods can apply to FSANZ to put the neural tube defect claim on their products
- Some foods get around this regulation by indirectly linking the ingredient to a health benefit and providing scientific evidence for the claim, e.g.
- Logical® is a margarine spread that contains plant sterols, which are known to lower cholesterol levels. However, its label claims that the spread ‘lowers cholesterol absorption’ hence directly cutting the link between the use of the spread and ‘treating’ elevated cholesterol levels
